ＮＣＣＡＯＭ（Ｎａｔｉｏｎａｌ　Ｃｅｒｔｉｆｉｃａｔｉｏｎ　Ｃｏｍｍｉｓｓｉｏｎ　ｆｏｒ　Ａｃｕｐｕｎｃｔｕｒｅ　ａｎｄ　Ｏｒｉｅｎｔａｌ　Ｍｅｄｉｃｉｎｅ）が行っている鍼灸資格認定試験に受かる必要があります。現在43の州とコロンビアの特別区は、鍼灸医療開業免許の必要条件として、ＮＣＣＡＯＭ認定試験または証明書を必要としています。開業鍼灸師を管理している州の98パーセントが、ＮＣＣＡＯＭ試験を利用しています。これらの州においてＮＣＣＡＯＭ試験は認められており、鍼灸院を開業するための適性を判断する条件として活用されています。例外として、カリフォルニア州では独自の鍼灸資格試験を行っており、その資格はカリフォルニア州のみ有効のようです。大多数の州がＮＣＣＡＯＭ試験を利用しつつも、各州において鍼灸医療開業免許を交付する条件が別に定められています。必要な実技、講義など州によって異なります。鍼灸医療開業における各州の必要事項は、常に確認する必要があるようです。

　また、1991年より、すべての鍼灸師免許申請者は「清潔な鍼」（クリーンニードル操作）の訓練及びその試験を受けることが義務付けられています。鍼灸師資格試験とクリーンニードル学習をクリアすると鍼灸師免許が交付されます。
　鍼灸師免許は２年ごとの更新制となっており、更新する際には一定時間の講義を受ける必要があります。

　アメリカでは、現在50州中46の州で鍼灸治療をいろいろな制約があります。
以下列記致します。

【医師、時にオステオパシー医師だけが、鍼施術できる州】
アラバマ、アリゾナ、ジョージア、イリノイ、インジアナ、ケンタッキー、ルイジアナ、ミシシッピー、ネブラスカ、ニューハンプシャー、ノースダコタ、オハイオ、オクラホマ州。
　鍼灸師に認められていない。医師、時にはオステオパシー医師、まれに日本にはない資格である足の医者（足のウオの目やタコ、足の内反や外反母趾の治療にあたる。ヨーロッパにも類似の医師資格がある）が鍼灸施術を認められる。

【医師の監督下でのみ施術できる州】
　サウスカロライナ、カンサス、ミシガン、ミズウリー州。
　一般に医師の監督がなけれは施術ができない。時にはオステオパシー医師やカイロ医師の監督下でも良いとされることがある。（特にカンサス州）

【鍼灸に関する法律が無い州、あるいは届け出のみで取り締まりのない州】
　アラスカ、アイダホ、サウスダコタ、テネシィ、ワイオミング州。
